Elements of Competency Performance Criteria              
Element: Initiate preliminary file activities
  • Liaise with legal officer to discuss new legal matter file, and to plan and prioritise preliminary work
       
Element: Obtain details of legal matter from client in accordance with organisational procedures
       
Element: Clarify matter with legal officer and client, and document agreed mutual expectations
       
Element: Prepare initial file documentation in accordance with organisational procedures
       
Element: Carry out conflict of interest test
  • Carry out conflict of interest check in accordance with organisational and legal procedures
       
Element: Record on preliminary file notes results of conflict of interest check and discuss and resolve any areas of potential conflict with legal officer
       
Element: Open legal matter file
  • Locate, access and extract relevant information for initiating files in accordance with organisational procedures

Element: Forward to client, on behalf of legal officer, confirmation of instructions, details of those working on the matter, a summary of work to be performed and associated timelines, in accordance with organisational procedures

Assessment Tasks

Write these in plain English and spell out how, when and where the task is to be carried out, under what conditions, and what resources are needed. Include guidelines about how well the candidate has to perform a task for it to be judged satisfactory.
